Understanding Music Sample Clearance

Sampling in music requires navigating complex legal waters. To legally use a segment of an existing recording, you typically need two distinct permissions: Master Clearance and Publishing Clearance.

What is Master Clearance?

Master clearance (or Master Use License) grants permission to use a specific sound recording. This covers the actual audio – the performance, the production, the sonic fingerprint of the track itself.

The sound recording copyright protects the unique interpretation and recorded version of a musical work. Think of it as the rights to the specific audio file.

Who Owns It?

Typically, the owner of the master recording is the record label or the independent artist who financed and produced that particular recording.

What is Publishing Clearance?
